Hi there

We are considering using this product for our support engineers, but before we do, we need to understand the licnesing issues attached to using this product on multiple machines. Can someone please let me know where we stand with regards to creating a CD with our own copies of XP pro and then using it on customers machines for diagnostic purposes.

Many thanks

When using BartPE you should know that:

   1. It is legal to make a "backup copy" of ANY files from your original Windows XP/2003 media to another media.
   2. It is legal to add any other files you wish to the backup media.
   3. It is not legal to use a BartPE CD and an installed Windows XP/2003 both at the same time under the same Windows XP/2003 EULA.
   4. It is not legal to change any binary files in the process according to the Windows XP/2003 EULA. This makes "winlogon" and "bootscreen" hacks illegal.
   5. A BartPE image is (and I quote) "not a properly licensed WinPE". This means that if you want to have a licensed WinPE, you cannot use BartPE. However, you can use a BartPE image under the license of the Windows XP/2003 EULA that came with the BartPE XP/2003 source media.

I feel that, considering the above, Microsoft cannot say that BartPE is illegal. If you don't break the rules of (3), (4), (5) and you don't make more than one BartPE CD without having more than one Windows XP/2003 license, you can use it any environment.

The PE Builder download archive does not include any plugins that will break any of the rules show above. But you must be careful with plugins created by others!

I think it's a bit of a grey area, maybe Steel might be able to offer more insight onto the legalities of what you are wanting to do. I suspect that if you use this CD on a licensed XP PC you would be OK, using it on a 9x, 2k PC I think it could be getting into a very murky grey area.

Some software on the CD ie AntiVir you couldn't use as it's for personal use only, there are other's on the CD as well which are just for personal use.

However Trend Micro Sysclean is free for you to use, and you could always add clamwin to the CD.

Well I have read several articles, etc. on this subject. Basically what I took from them and the license for XP is:
You own 1 license of your XP software to run on your computer, you are simply making a "backup" of your XP CD when creating this project. As long as the system you have XP installed on turned off, you can use that "backup" CD (or project) on any other system. You are only using your license in one instance! That technicality should work out, just tell MS you had your machine turned off!! cool.gif

That is just my interpretation of the EULA and license. Many people hold that assumption however I don't know if it truely validated by any MS personnel. I wouldn't see MS holding a press conference to announce to the users of BPE that they are legal using it, they don't really like BPE that much from what I have heard. But it doesn't break any laws so Bart's legal experience with MS was closed long ago, just like mine! Remember, MS did step in with a "cease and desist" order to Bart because of his first version of PE Builder. It contained MS files in the beginning so he just rewrote and reworked everything necessary for it to be a legal project/product!

Any additional questions or comments on this??

That seems logical.

Just install XP on a old PC then and stick it in a cupboard.

At my current job for the government, I make several of these CDs (actually combo CDs that also include the UBCD among other things) for our office and the other offices in several different states. We have a corp. or enterprise license for XP and whatnot so it's legal in that area and I also make sure to disable all free for personal use only software on the CD to make sure we are legal there as well. I think that if you have those requirements met, then there's no problem using the CD in any business/corporate environment. smile.gif

Good advice and information! Thanks for moving this topic also LittlBUGer, it is needed here.

Did you PM the indivdual though to let them know we moved his question here to FAQ?
LittlBUGer
Ummm... I didn't move anything.... LOL smile.gif

?? Ok, I think I'm trying to do too many things at one time?? I think I'll leave the forum for a bit and finish cleaning my office. wacko.gif

According to this: http://www.tulane.edu/~software/msselect/d...grade_chart.pdf

If you own an XP License you may use an older version of Windows like 9x or NT with that license. biggrin.gif

Is there a list of the "Free for personal Use" software included? This would make it much easier to disable them.
SteelTrepid
Hmmm, that's a pretty darn good idea! Duh, I should have made one sooner! I'll add it to my list of To-Do items, however the list is pretty long so it will be a while until I can get to it. Thanks for the suggestion!

Here's what I have found a while ago (hasn't been updated in almost 3 months, but it does help):

The software is "freeware" for: Home users (using the computers for personal hobby or recreational use); Government controlled education institutions; Non-profit organizations; charity organizations; Public libraries. The term "freeware" means, you are allowed to use the software at no cost. It is not necessary to purchase a license for it.

If your environment does not fit in the noted environments, you are considered as a commercial institution and the software is licensed to you as "shareware". The term "shareware" means, you can test the software for up to 30 days. After those 30 days you either have to purchase a license for it or stop using the software and remove it from your storage device(s) immediately. Unregistered use of X-Setup Pro after the 30-day evaluation period is in violation of international copyright laws.

From the Ultimate Boot CD:

F-Prot Anti-virus for DOS: Free for Home/Individual use ONLY.

McAfee Anti-virus for DOS: Free for Home/Individual use ONLY.

I'm going to update it again soon, probably when a new release comes out. For the ones above, I went through each program thoroughly to make sure of my findings. smile.gif

Probably also should add this to the FAQ for our corporate users... wink.gif

I'm adding my newfound results to the official FAQ. There's only a few changes to the list above. smile.gif

First I would like to thank you for a wonderful product! If you only knew or could even imagine how many times your work has blessed me in my day to day task, you would probably not believe it! I do not beleive there is one or two days that go by at most that ubcd4win does not assist me!

I rarely post but do read the forum and am amazed at the amount of work you are putting into this. Even though I mostly use this in my day to day work, I will be donating personally to help you as best as I can.

I hope this is the appropriate area to post this question, but if not please move it to the correct area. I am in an enterprise IT environment and we use a number of tools to do our task. I am mostly in the desktop engineering aspect working with Business Desktop Deployment and other technologies.

I wear many hats (WAY TOO MANY!) and do all the ghosting, image building/updating, troubleshoot complex problems, etc., but I rarely spend much time in comprising boot cds or the like and I have to re-learn because of the time between working with the boot environment is too long (I usually download what I need and use it "from the box" you might say or work with stuff I have pre-built).

However, we are often plagued with needing the ability to run some of our enterprise toosl/applications from a boot cd. One such tool would be our corporate AV solution, others would be malware removal tools, disk tools, file agents, recover agents, etc. (Currently for AV we are using Symantec AV 9 soon updating to 10). Often we have to ship computers back to our corporate headquarters for repair because they get so corrupted and this is a great cost to our company.

We have multiple boot cds and would like to incorporate into one cd or even better a DVD (an or possibly a USB stick) solution with a "menu" that we could select which environment we would like to use. More importantly is there anyone using commercial apps such as Symantec AV from a "boot" cd as ubcd4win, or could you point me into the right place to get assistance with this type of issue.

We are also licensed for "winpe" in our windows environment and I was wondering of any legality issues that could occur with using that along with ubcd4win? Not long ago I met with Microsoft BDD engineers and we do know they are loosening up some with the winpe environment. We are now able to put many tools in that environment and I believe we will see that loosen up further in the days ahead.

Still I believe the ubcd4win is a better "tools" environment. At any rate, I do thank you and appreciate ANY feedback you can give me.

As for the licensing issue I don't believe you have one.
